Terms and Conditions Pleio

These general terms and conditions apply to:

Article 1: Facilities

Pleio: the collaboration software including, all offered modules, groups and sub-sites.
File sharing: a Pleio-hosted Filesender authority.
Learn Pleio: a Moodle organisation, hosted by Pleio.
Pleio survey: a Limesurvey agency hosted by Pleio.
Pleio control: the management panel for the Pleio main managers. This allows the main administrators to create new sub-sites, create test environments and copy sites between data centres. Unless we explicitly indicate that separate or additional conditions (instead of these conditions) apply.

We ask you to agree with the following agreements when participating with Pleio:

Article 2: Participants’ expectations indicate:

Use Pleio for matters that contribute to the public matter. Do not misuse the platform for purposes other than the public matter, such as advertising and commercial aims.
Be transparent in sharing your personal data; use your own name and no fake-names.
Do not share your password, give access to others on your Pleio account and do not transfer your account to someone else.
Treating others as you want to be treated is one of our golden rules.

Article 3: Responsibility for information and dealing with Intellectual Property

All content published on Pleio will not be publicly available and does not become Pleio’s property, but remains property of the user or the company you work for.
Do not infringe the intellectual property of others. Pleio respects intellectual property and expects the same from its users.
If you are the owner of a group or a sub-site and you receive a report of unlawful data, please delete this information immediately.
Immediately report unlawful posted data (which is in violation of any law or with the object of Pleio) to the administrator of the subsite or group, or via button the 'report abuse' on pleio.nl.
No rights can be derived from the information, tools, etc. that are available on the website.

Article 4: Privacy and transparency

Pleio collects your personal data in order to provide the previously described service. Our Privacy Statement explains how we treat your personal data and how we ensure that your personal data is protected.
By accepting these Pleio conditions, you agree that we may use your personal information in accordance to our privacy policy. It is also possible that we, or the sub- site (s) send you service messages by e-mail in case of faults and renewals of the site (s). If you have given permission to receive the newsletter, then you will continue to receive the newsletter until further notice of cancellation.
Your name and profile picture on Pleio are always visible to the public and can also be found by search engines. In your profile you can add additional profile data per sub- site. You can change your profile settings by changing the public visibility.
Pleio represents openness and knowledge sharing. That's why you can choose from different access levels when placing content. Transparency isn’t always possible, and thus, Pleio expects its users to take responsibility when placing content and choosing the right level of access.
If you register for an event or agenda item on pleio.nl or a Pleio sub-site, the event’s organiser can consult your registration details and use it to send you a confirmation or to inform you about other relevant matters that belong to the event. The organiser is responsible to comply with the rules for processing and storing your data.
When you create an event or calender entry on Pleio or one of its sub-sites, you are responsible to comply with the terms and conditions for processing and storing privacy data. Do not store such privacy information beyond the period necessary for the purposes for which it was transmitted. If you do, sensitive information cannot be always guaranteed.

Article 5: Unsubscribe from sub-sites and groups and cancelling your account

Placing content that is in violation of any law, or with what Pleio wants to convey, the administrator of Pleio can remove this content at any time, block your account and, in case of violation of the law, report this.
Store your obsolete documents and other information regularly in order to keep Pleio up-to-date and well organised.
If you no longer wish to be a member of a group on pleio.nl or on one of the sub-sites you can unsubscribe yourself by going to the group and clicking on 'Discard group'. Your created content will still be retained and also remain a member of the sub- site.
If you no longer want to be a member of a sub-site, you can mail the administrator with the request for deletion. Your Pleio account will still exist as well as your membership of any other sub-site.
If you no longer want to use Pleio at all, you can have your account removed at any time by sending an e-mail to admin@pleio.nl.

Article 6: Liability

As far as legally permitted; “The Pleio Foundation” is not liable for damage caused by any use of Pleio.

Article 7: Availability Pleio

Pleio endeavours to keep the availability of the platform as high as possible.

Article 8: Development Pleio

Pleio will communicate in advance changes in the functionality and / or design of Pleio, via partite owners and Pleio Support.

Article 9: Modification of the General Terms and Conditions

Pleio will communicate a change of these general terms and conditions to its users by showing them when logging in on their account.

Article 10: Applicable law and competent court

Dutch law applies exclusively to all agreements, even if a client is resident or established abroad.
The applicability of the Vienna Sales Convention is excluded.
All disputes between parties will first be settled before they are submitted to the competent court.
Disputes between Pleio and a client that cannot be resolved by mutual agreement will only be submitted to the competent court.
